The real ship verdict still out
The Supreme Court ruled the right way in the access on cruise ships case. At least as right as any ADA ruling can get. The supremes said the ADA does apply to cruise ships operating in US waters, even if they are foreign flagged. Of course because of the vagaries of the ADA, that doesn’t mean ships will be compelled to retrofit older vessels. But it should at least mean something for new ones, one would hope. The decision was a close one, 5-4. The disabled passengers who filed the suit can now go to court to prove discrimination. I wish them well. Scott Rains' perspective is here. Candy Harrington’s here.
